Terms governing ATechSolutions IT services
These terms apply to all IT support services provided by ATechSolutions to clients in Greater Montreal and surrounding areas.
Scope of these terms
These Terms and Conditions govern all IT support services provided by ATechSolutions (operated by Anthony Martins) to clients in Greater Montreal and surrounding areas. By requesting or receiving services, you agree to these terms.
Services and pricing
Services are described on our services page and quoted on a per-project or per-hour basis. Hourly rates are billed in 15-minute increments for remote support and 30-minute increments for on-site visits. Quoted prices are subject to change with 30 days' notice for ongoing arrangements.
Hardware and third-party costs
Hardware, software licences, and third-party service costs are billed at cost plus a 15% handling and procurement fee. Clients will be notified of any third-party costs before purchase. ATechSolutions does not mark up manufacturer warranties or extended service plans.
Payment terms
Project work is invoiced upon completion. Monthly managed support plans are invoiced at the start of each billing period. Payment is due within 14 calendar days of invoice. Overdue accounts may be subject to a 2% monthly late fee. ATechSolutions reserves the right to pause service on accounts more than 30 days overdue.
Client responsibilities
The client is responsible for:
- Providing accurate information about their systems and environment
- Ensuring ATechSolutions has the necessary access to perform the work
- Maintaining current backups of all important data before any repair or configuration work
- Complying with software licence agreements on their own systems
Limitation of liability
ATechSolutions will perform services with reasonable care and skill. However, we are not liable for:
- Data loss resulting from pre-existing hardware failure
- Loss of business income due to IT issues or service delays
- Damages exceeding the total amount paid for the specific service in question
Confidentiality
ATechSolutions will not disclose client systems, data, or business information to any third party without explicit consent, except as required by law. Clients agree to treat any ATechSolutions proprietary processes or tools encountered during service delivery as confidential.
Cancellation and rescheduling
Scheduled appointments may be cancelled or rescheduled without penalty up to 24 hours before the appointment. Cancellations with less than 24 hours' notice may be subject to a 1-hour service charge. ATechSolutions reserves the right to reschedule due to unforeseen circumstances.
Monthly managed support plans
Monthly support plans require a minimum 3-month commitment. After the initial period, plans may be cancelled with 30 days' written notice. ATechSolutions reserves the right to adjust plan pricing with 60 days' advance notice. Unused included hours do not carry over to the following month.
Intellectual property
Any custom scripts, documentation, or configurations created specifically for a client project become the property of the client upon full payment. ATechSolutions retains the right to use general techniques and knowledge gained during service delivery for other clients.
Governing law
These terms are governed by the laws of the Province of Quebec and the applicable laws of Canada. Any disputes will be resolved in the courts of Quebec, in the judicial district of Laval or Montreal.
